The CBI said that it will file a Special Leave Petition (SLP) before the Supreme Court seeking to set aside the relief granted to Kuldeep Singh Sengar in the Unnao rape case.

Unnao Rape Case: The Central Bureau of Investigation (CBI) on Wednesday said that it will challenge the Delhi High Court’s order granting bail to former BJP MLA Kuldeep Singh Sengar in the 2017 Unnao rape case and will approach the Supreme Court at the earliest.
The probe agency said that it has examined the order passed by a Division Bench of the Delhi High Court, which suspended Sengar’s sentence and granted him bail while his appeal against conviction is pending. It said that the CBI will file a Special Leave Petition (SLP) before the Supreme Court seeking to set aside the relief granted to the convict.
“CBI has studied the orders of the Division Bench of the Delhi High Court in the Unnao Rape Case and has decided to file an SLP before the Hon’ble Supreme Court at the earliest against the orders of the High Court granting bail to the accused K D Sengar by suspension of the sentence,” a CBI spokesperson said in a statement.
It said that the probe agency had strongly opposed both Sengar’s appeal and his bail petition before the Delhi High Court. The agency had filed detailed replies and written submissions in a timely manner, arguing against the suspension of sentence.
“It is we who investigated and got the conviction after trial… There is no question about going soft on it,” a top CBI official said.
Rahul Gandhi Meets Rape Survivor
Earlier today, the rape survivor, her mother, and activist Yogita Bhayana met Lok Sabha Leader of Opposition Rahul Gandhi at 10, Janpath Road in New Delhi, and the latter assured the victim’s family all possible support in their fight for justice and safety.
In the meeting, the survivor and her family placed three requests before Rahul Gandhi, expressing concerns over their legal battle, personal security and livelihood.
After the meeting, the survivor said that Rahul Gandhi called on his own and expressed a desire to meet her. She also said that both Rahul and Sonia Gandhi “had tears in their eyes,” and they assured her that they would help her get justice.
Ahead of the meeting, the victim vowed to get justice, saying that she even wants to meet Prime Minister Narendra Modi, President Droupadi Murmu, and Home Minister Amit Shah.
Survivor’s Mother Manhandled
Earlier today, security personnel in New Delhi reportedly stopped the victim and her mother from holding a protest against the Delhi High Court’s decision and manhandled the elderly woman.
The survivor and her mother have been protesting at India Gate against the decision. Earlier on Tuesday, the duo, along with Bhayana, was detained. On Wednesday, they had planned to address the media at Mandi House. However, the CRPF-escorted bus they were travelling in allegedly did not stop at the designated location.
The security personnel allegedly stopped the survivor and her mother from addressing the media and also forced the elderly mother to jump off a moving bus. They were seen pushing and elbowing the elderly woman, after which she disembarked while the bus drove away with the survivor still inside. Notably, there were no women CRPF personnel present on the bus, despite it transporting the survivor and her mother.
Survivor Slams Delhi HC Order
Slamming the Delhi High Court order, the survivor said it was “the first of its kind in the nation,” as the sentence was stayed and bail granted.
“All the daughters of the country are now afraid that they will be raped, and the criminals will get away with it… They have confined us to our homes by giving him the order to stay 5km away from us… I have faith in the Supreme Court that it will give us justice…,” she said.
What’s The Delhi HC Order?
The Delhi High Court on Tuesday suspended the jail term of Sengar, who is serving life imprisonment, saying he has already served seven years and five months in prison.
Sengar’s sentence has been suspended by the high court till the pendency of his appeal challenging his conviction and sentence in the rape case. He has challenged a December 2019 trial court verdict in the case. He will, however, remain in jail since he is also serving 10 years’ imprisonment in the custodial death case of the victim’s father and has not been granted bail in that case.
Imposing several conditions, the bench of Delhi High Court Justice Subramonium Prasad and Justice Harish Vaidyanathan Shankar directed Sengar to furnish a personal bond of Rs 15 lakh with three sureties of the like amount.
