As couples rethink marriage after decades together- empty nests, retirement, emotional distance and changing priorities are reshaping marriages now.

In grey divorce cases, courts consider factors including the long duration of the marriage and sacrifices made by the dependent spouse or wife while determining appropriate maintenance and seeking to protect their financial wellbeing.

There is a particular kind of silence that can settle into a long marriage. It is not always the silence of anger or conflict. Sometimes, it is simply two people living beside each other after years of having lived for the same responsibilities.

The children have grown up, careers are winding down, retirement is approaching or has already arrived, parents may need care, the house is quieter and suddenly, a couple that spent decades managing a family is left with a question they may have postponed for years: What does our relationship look like when everything else falls away?

This is part of the story behind what is commonly called grey divorce, referring broadly to couples who separate or divorce later in life, often after the age of 50.

It can be easy to assume that such a decision must have been sudden. But people who work closely with couples going through it often see something very different: a relationship that may have been changing quietly for years.

Why Do Couples Divorce After Spending Decades Together?

Adv. Shaili Muzoomdar, Matrimonial Lawyer, says one of the most common reasons she sees is that spouses simply grow in different directions over a long marriage. “In a long term marriage, with passing years, it often happens that the spouses grow at a different pace and in different directions,” she says.

That difference can gradually create emotional distance, disagreements and discord. Goals that once seemed shared may no longer be, expectations for the next phase of life can look completely different.

Eventually, the couple may realise they are no longer on the same page. Muzoomdar also points to another increasingly visible reason among couples over 55: one spouse finding love and companionship elsewhere.

“With society warming up to marriages for people above 60, they see a chance for a fresh beginning,” she says.

Why Do Couples Stay Together In Unhappy Marriage?

This is perhaps one of the most misunderstood parts of grey divorce. Ravi Mittal, Founder and CEO of Rebounce, says these separations are often neither sudden nor impulsive.

“Many people hear grey divorce and think either it’s too late for such a major life decision, or it might have been an impulsive one. In reality, it’s neither late nor sudden,” he says.

According to Mittal, couples may have spent years functioning around shared responsibilities such as raising children, managing a household or building careers. Those responsibilities can provide structure to a marriage, even when the relationship between the two people has changed.

“And suddenly, life leaves you confronting a deeper question: if no joint responsibilities are holding us together, will we still choose each other?” Mittal says. For some couples, the answer can be a difficult no.

Why Is Grey Divorce Rising In India?

Empty Nest

Retirement and an empty nest can be surprisingly difficult adjustments because they remove some of the routines that have kept a couple occupied for decades. Dr Munia Bhattacharya, Senior Consultant, Clinical Psychology, Marengo Asia Hospitals, Gurugram says, “Until couples experience empty nest, life has a structure. There is work, children, household responsibilities and very little time to stop and ask what the relationship itself has become”.

Some couples may discover that they have been effective parents and efficient family members, but have gradually stopped being companions.

Once children leave home or work ends, that emotional distance can become much harder to ignore. “The silence between them can feel much louder,” Dr Bhattacharya says.

Retirement

Retirement can expose another divide: what each person imagined their later years would look like. One partner may dream of travelling, spending more time together and enjoying a slower pace. The other may finally want to pursue hobbies, friendships or interests that had been put aside for years.

Neither desire is necessarily unreasonable but if these expectations were never discussed, they can become a source of conflict.

There may also be responsibilities towards ageing parents or adult children, creating another layer of pressure.

Importantly, Dr Bhattacharya says these life changes do not necessarily create every problem in a relationship. “Often, they reveal what a busy life had allowed couples to ignore,” she says.

Unresolved Conflicts

The answer may have less to do with becoming less patient and more to do with becoming more aware of what they want from life. When people are younger, leaving a marriage may feel practically impossible. There may be children, financial dependence, family expectations or a deeply ingrained belief that adjusting is simply part of being married.

Over decades, however, small disappointments can accumulate. “In counselling, one often hears that the problem was not a single incident,” says Dr Bhattacharya. “It was years of not being listened to, feeling emotionally alone, carrying most of the responsibility or constantly being expected to adjust.”

Emotional Disconnect

As people grow older, the question they ask themselves can change. Instead of asking, “How do I keep this marriage going?”, they may begin asking, “Do I want to live the rest of my life like this?”

Dr Bhattacharya says this does not necessarily mean older adults have suddenly become unwilling to compromise. “Sometimes, it means they have finally recognised the difference between compromise and repeatedly abandoning their own emotional needs,” she explains.

For someone who has spent decades putting family responsibilities first, this can be a profound realisation.

Property & Finances

By 50, a couple may have accumulated property, savings and other assets together, even if much of the wealth is legally held in one person’s name. According to Adv. Muzoomdar, under the Hindu Marriage Act and Parsi Marriage and Divorce Laws, a dependent spouse may be entitled to alimony or maintenance from the financially secure spouse. Under the Special Marriage Act and Indian Divorce Act, a wife may be entitled to maintenance from the husband, depending on the circumstances.

A wife does not automatically become an owner of the matrimonial home simply because she has lived there for years. However, Muzoomdar notes that she retains the right to reside in the matrimonial home.

In grey divorce cases, courts consider factors including the long duration of the marriage and sacrifices made by the dependent spouse or wife while determining appropriate maintenance and seeking to protect their financial wellbeing.

The exact legal position depends on the couple’s circumstances and the applicable personal law, so anyone considering separation should seek individual legal advice rather than rely on general information.

None of this makes the decision simple. Ending a long marriage after decades of shared life involves practical, emotional and social reckoning. Yet the rising visibility of grey divorce points to a quieter change in how people evaluate the later chapters of their lives.

Grey divorce refers to couples who separate or divorce later in life, often after the age of 50. It is rising in India due to factors like spouses growing in different directions, the ’empty nest syndrome’ when children leave home, differing expectations during retirement, and unresolved conflicts that become harder to ignore as life slows down.

Common reasons for grey divorce in India include spouses growing apart over time, one partner finding companionship elsewhere, and the dissolution of shared responsibilities like raising children or managing careers, which previously provided structure to the marriage. The ’empty nest syndrome’ and differing retirement expectations also contribute to this trend.

In India, legal and financial implications of grey divorce depend on the applicable personal law. Under the Hindu Marriage Act and Parsi Marriage and Divorce Laws, a dependent spouse may be entitled to alimony or maintenance. Under the Special Marriage Act and Indian Divorce Act, a wife may be entitled to maintenance. Courts consider the marriage’s duration and sacrifices made by the dependent spouse when determining maintenance.
