Ahmedabad: The National Medical Commission (NMC) has filed an appeal before a division bench of the Gujarat high court challenging a single judge’s order of temporarily staying NMC’s decision to halt MBBS admissions at Swaminarayan University for this academic year.
On July 18, the Swaminarayan Institute of Medical Science and Research at Kalol was instructed not to admit MBBS students.
This directive followed the Central Bureau of Investigation FIR that named a university official in an alleged NMC-related scam concerning the authorization of medical colleges. In response to the NMC’s admission ban, the university sought legal recourse from the high court.
The court’s ruling highlighted the NMC’s decision to suspend admissions due to alleged criminal and unethical activities, as detailed in the CBI’s FIR, and issues with faculty attendance based on Aadhaar-enabled Biometric Attendance System (AEBAS) data. NMC claimed that out of 144 required faculty members, the college had a shortfall of 54. Challenging NMC’s decision, the university argued that it was not named in the CBI ‘s chargesheet despite being mentioned in the FIR.
Furthermore, the university contended that the alleged faculty deficiencies were within permissible limits, and there was no reason for NMC to stop MBBS admissions.
In Sep, Justice Nikhil Kariel issued a notice and sought a reply from the NMC.
Meanwhile, the high court stayed the order passed by NMC’s Undergraduate Medical Education Board on July 18 and by an NMC appellate committee on Sep 10. The court sought an undertaking from the college dean to ensure faculty members meet the necessary attendance requirements.
“The petitioner, through the dean of Petitioner no.2 – College – shall file an undertaking before this court in the present petition as regards the institution undertaking to maintain attendance as per the required norms i.e. more than 75% of working days for all faculty members. Such undertaking shall be filed by Sep 19, 2025.”
